hereinafter referred to as: “Choco Champi”

and operating the website www.chocochampi.com

and, on the other hand,

by any individual or legal entity wishing to make a purchase via the website www.chocochampi.com, hereinafter referred to as the "buyer".

Article 1. PURPOSE

These terms of sale aim to define the contractual relationship between Jerycan Cz s.r.o. and the buyer, as well as the conditions applicable to any purchase made through the website www.chocochampi.com. The purchase of a product through this site implies an unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read before placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the site www.chocochampi.com is not directly related to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity, allowing them to commit to these general terms of sale.

Jerycan Cz s.r.o. retains the possibility of modifying these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 2. PRODUCTS

The products offered are those listed on the website www.chocochampi.com of the company Jerycan Cz 

s.r.o., within the limits of available stocks. Jerycan Cz s.r.o. reserves the right to modify the assortment of products at any time.

Each product is presented on the website with a description containing its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but do not engage the Seller. The sale of products presented on the site www.chocochampi.com is intended for all buyers residing in countries that fully allow the entry of these products into their territory.

Article 3. PRICES

The prices listed on the product sheets in the internet catalog are in Euros (€) all taxes included (VAT), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Jerycan Cz s.r.o. reserves the right to change its prices at any time, while understanding that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which will be invoiced in addition to the price of the products purchased, based on the total amount of the order.

Article 4. ORDER AND PAYMENT TERMS

Before placing an order, the buyer must create an account on the website www.chocochampi.com. The account creation section is accessible directly from the side menu bar. During each visit, if the buyer wishes to order or consult their account (order status, profile, etc.), they must identify themselves using their information. Jerycan Cz s.r.o. offers the buyer the option to order and pay for products in several steps, with 3 payment options to choose from:

Payment by bank transfer: The buyer selects the products they wish to order in the "cart," modifies if necessary (quantities, references, etc.), verifies the delivery address, or provides a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by bank transfer." Finally, the last step offers the buyer the opportunity to review all the information, acknowledge and accept these terms of sale by checking the corresponding box, and then invites them to confirm the order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation, confirming the registration of their order. To finalize the payment and initiate the processing of the order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to the bank account of Jerycan Cz s.r.o., the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed, and the buyer will be notified by email. Jerycan Cz s.r.o. will ship the products no earlier than 2 working days after receiving the transfer corresponding to the order, subject to availability.

Secure payment by credit card: The buyer selects the products they wish to order in the "cart," modifies if necessary (quantities, references, etc.), verifies the delivery address, or provides a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier.

Next, the buyer chooses their preferred payment method: "Payment by credit card." The next step asks the buyer to verify all the information, acknowledge and accept these terms of sale by checking the corresponding box, and then invites them to confirm the order by clicking the "Confirm my order" button. If the payment is accepted, the order is registered, and the contract is definitively formed. Payment by credit card is final. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the amounts paid will be credited or refunded. The cardholder will not be liable if the disputed payment has been proven to have been made fraudulently, remotely, without the physical use of their card.

Confirmation of an order implies acceptance of these terms of sale, acknowledgment of having full knowledge of them, and waiver of any other conditions of purchase. Jerycan Cz s.r.o. will ship the products no earlier than 2 working days after receiving the credit card payment corresponding to the order. All the data provided and the order confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, Jerycan Cz s.r.o. will send them an email confirming the registration of their order.

Article 5. RETENTION OF TITLE

Jerycan Cz s.r.o. retains full ownership of the products sold until the price, including principal, costs, and taxes, is fully collected.

Article 6. RIGHT OF RETURNS

The buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.

Article 7. DELIVERY

Deliveries are made to the address indicated on the order form, which can only be within the agreed-upon geographic area. Orders are fulfilled by GLS, a delivery service with tracking and delivery without a signature. Delivery times are given for indicative purposes only; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer will be reimbursed. Jerycan Cz s.r.o. may provide the buyer with the tracking number of their package by email. The buyer is delivered to their home by their mail carrier. In case of the buyer's absence, the mail carrier will leave a notice of attempted delivery, allowing the buyer to pick up the ordered products at the nearest post office within a timeframe indicated by postal services. The risks related to transportation are borne by the buyer from the moment the items leave the premises of Jerycan Cz s.r.o.. The buyer is required to check the condition of the packaging and the contents of the goods upon delivery in the presence of the GLS representative or the delivery person. In the event of damage during transport, any complaints must be made to the carrier within three days of delivery.

Article 8. WARRANTY

All products supplied by Jerycan Cz s.r.o. benefit from the legal warranty provided for in Articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to Jerycan Cz s.r.o., which will take it back, exchange it, or refund it. All claims, exchange requests, or requests for reimbursement must be made by postal mail to the following address: Jerycan Cz s.r.o. - Vojtěšská 211/6, Nové Město (Praha 1), 110 00 Praha (Czech Republic), within thirty days after delivery.

Article 9. LIABILITY

In the process of distance selling, Jerycan Cz s.r.o. is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network, such as data loss, intrusion, virus, service interruption, or other involuntary problems.

Article 10. INTELLECTUAL PROPERTY

All elements of the website www.chocochampi.com are and remain the intellectual and exclusive property of Jerycan Cz s.r.o.. No one is authorized to reproduce, exploit, or use in any capacity, even partially, elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11. PERSONAL DATA

Jerycan Cz s.r.o. undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. In this regard, the user has the right to access, modify, and delete information concerning them.
